This data protection declaration of Hub Plasma governs the processing and processing of your (hereinafter «You» or «the user») data, personal and otherwise, by Hub Plasma or third parties, relating to the use of our website www.hubplasma.com.

This Data Protection Declaration governs the handling of historical and future data. The corresponding approval by the user therefore concerns not only the data that will be processed in the future, but also the data that we have already saved.

2. What are personal data and the processing of personal data?

Personal data is all information relating to a specific natural or legal person or an identifiable person. This includes, in particular, information relating to your identity, such as your name, e-mail address and possibly also your IP address and device ID. In this privacy statement, the generic term "data" also refers to non-personal data and data in anonymous form.

Processing means the handling of data of all kinds, in particular the collection, storage, use, modification, communication, archiving or destruction of data, regardless of the means or by the processes used.

3. What kind of personal data do we collect?

We collect and process personal data in many situations and for various purposes. When you visit our website, purchase our products in the online shop, leave a review, contact our customer service or communicate with us using one of the available channels, we collect information to improve the service we offer you.

We also obtain information from third parties. In all cases, data acquired from third-party providers is treated with the same care and security as other personal data managed by Us.

The data we collect depends on the service for which it is used. 

4. When do we collect personal data?

We collect personal data:

  • When you contact us.

  • When you contact our customer service at info@hubplasma.com . 

  • When you interact with us on social media (mentioning and tagging us or contacting us directly).

Personal data may also be collected from other sources; this data includes in particular data of mailing list brokers and information about you that third parties pass on to us , for example in the context of an administrative or judicial proceeding or in the course of communication activities with Us.

This information is collected and saved on our servers or on third-party servers (see paragraph 6) or locally on your device when we use, for example, your browser memory and application caches.

5. How do we process your personal data?

We process your personal data mainly in connection with the purchase of products on the Internet via our Internet Site ( www.hubplasma.com ), as well as for the specific purposes described below and for other purposes that we communicate to you separately or which are self evident:

  • for the execution of purchase contracts, including the management of shipping and payment activities, and the management of returns and complaints. More information on this is available in our  GCS.

  • for communication with the user and with third parties, as well as for customer assistance;

  • for advertising and marketing, e.g. for customer events, for sending specific information to target groups and for marketing communications by mail, e-mail and web push notifications;

  • for planning, administration and customization of our website;

  • for the verification and compliance with legal obligations, for the identification, detection and prevention of abuses and for the assertion of rights or the dismissal of claims;

  • for internal purposes, e.g. for the preparation and execution of corporate acquisitions and disposals and other related transactions, for the administration and management of our information technology and other resources, for accounting, archiving, training and other administrative purposes, for the control and improvement of our internal processes.

6. Forwarding of data to third parties

In order to be able to offer you our services, we also cooperate with other companies and other entities by commissioning them to process and save the data. These subjects also have access to your personal or usage data. 

However, we never sell personal data to third parties.

The data may be transmitted as indicated below.

  • Contractual partners / commissioned data processing : Sales agents or suppliers may also have access to the data to fulfill contractual obligations regarding the offer of specific services, for collection and marketing purposes, for usage analysis or to maintain the operation of our facility. Furthermore, where possible and appropriate, we ensure adequate anonymisation of the data. We also oblige our contractual partners to process the data exclusively for the achievement of the contractual purpose and only pass on the necessary information to them.

  • Abroad: We are also entitled to pass on your personal data to commissioned service providers (e.g. hosting and software service providers) operating abroad, provided this is functional to the data processing described in this privacy policy. Like us, these entities are also required to ensure data protection.

  • Legal reasons: In certain situations we may disclose your data to third parties (e.g. in the course of official investigations and/or criminal proceedings), for example where we are required to by law or where we can assume, in good faith, that the access, use, storage or transmission of data is necessary for the application of the applicable terms of use, to detect, prevent or combat fraud or security shortcomings or for the protection of the rights and property of HUB Plasma. In the event of a merger, acquisition or sale of a business, we will continue to ensure the confidentiality of personal information by notifying affected users before the information is disclosed or becomes the subject of another privacy notice.

If a service provider resides in countries where the applicable legislation does not provide for personal data protection equivalent to EU GDPR, Hub Plasma will in any case require him to comply with the rules and obligations established by EU law.

You have the option of objecting to this transmission at any time by sending us a message (point 12).

7. Cookies and other technologies

Together with our selected partners, we use the various technologies in use to collect, store and evaluate the data you provide us when you use our services. In particular, we use cookies, through which your browser or device can be identified. These are small files, created automatically by the browser you use, which are saved on your computer's hard drive or on your mobile device when you consult our services. With each new access, cookies recognize your browser and are able to save user settings and other information.

Some cookies are essential for the functionality of the website (such as the shopping cart of the online shop) and are automatically deleted at the end of the visit. Other cookies are used to memorize the settings in case of a subsequent visit, to compile anonymous statistics on the use of our website and to personalize the contents of our internet pages. The latter, if not deleted manually or blocked by default, remain stored on your computer or mobile device for a predefined period of time before being automatically deleted.

We also use third-party cookies to allow them to collect the data necessary for their services. 8. Log files

When you call up our services, your browser transmits certain information to us which for technical reasons is stored in log files, so-called log files. In particular, we save the time, duration and type of access to the service, the IP address of the device used, the type of browser, the Internet service provider and the operating system used, the address of the Internet sites from which you you have been redirected to our website and which you access after visiting us; amount of data transmitted.

The collection and analysis of this information helps us to continuously improve our services and to adapt them according to the needs of our customers, to correct errors, to ensure the security and stability of our systems, as well as to improve the ability of our servers based on usage volumes in order to optimize your experience of using our services. The user will not be identified and the information collected automatically will not be linked to your personal data.

The use of our services is measured and evaluated using various technical systems, mainly by third-party providers. Website tracking and analysis tools provide us with useful information and statistics to better understand how our services are used and therefore adapt them to user needs.

2.Google Tag Manager

Google Tag Manager has been integrated on our website. Google Tag Manager is a tool that allows you to manage and insert marketing tags (snippets or tracking pixels) on a website (or mobile app), without having to modify the code. Enables other tags that may be capturing your data.

10. Social Media Plugins and Other Integrations of Third Party Offers

Our services may be linked with other third party services and features. Sharing content on these platforms is simplified through the use of plugins.

When a user consults our services that contain this type of plugin, it is possible to automatically create a connection with the server of the relevant supplier, which in this way collects and saves predefined information (for example the time of consultation of the services, the type of browser and IP address). If you already have a user account, the provider can associate this information with your profile. If you then interact with the plugins (e.g. by clicking on the "Like" button or by entering a comment), this information will also be transmitted to the provider and then saved. 

In all these cases, the terms of use and data protection provisions of these providers generally apply, which you have accepted separately. Since we have no control over the use of data collected by third parties, we assume no responsibility for it.

Instagram is an audiovisual platform on which users can share photos and videos. Furthermore, Instagram offers its users the possibility of disclosing this data on other social networks as well.

Through cookies, Instagram collects information about your browsing habits on our website. Habits include, for example, your visits to the website or the subpages you have opened. Furthermore, Instagram has the option of associating this information with your Instagram profile. Instagram will receive this information even if you do not interact with the Instagram plugin.

3. LinkedIn

LinkedIn is a web-based social network that allows users to manage existing business contacts and create new ones.

LinkedIn does not save or use personal data generated by passive browsing on our website using the "Share on LinkedIn" button. Information about your passive surfing is not collected when you click on the "Share on LinkedIn" button, but simply when you visit our website on which the "Share on LinkedIn" button is located. When you interact with the "Share on LinkedIn" button (e.g. by sharing an article on LinkedIn), information relating to your "active surfing" is transmitted to LinkedIn.

11. Data protection / security / duration of data retention

We take appropriate technical and organizational precautionary measures to protect your data from access by unauthorized persons and from misuse. These measures are periodically monitored and adapted to technological progress. However we assume no responsibility for the loss, disclosure or use of data by third parties.

We keep personal data for the time required by law and in any case until the objectives set by the contract are achieved. We retain personal data even if we have a legitimate interest in doing so, e.g. for documentation and evidence retention purposes and for the protection and defense of legal claims, as long as they are subject to a legal retention obligation. 

We delete your personal data when it is no longer needed.

However, it should be remembered that the transmission of information via the Internet and other electronic means involves security risks and that we cannot provide any guarantees as to the security of information transmitted to us through these channels.

12. Right to information, access, rectification and cancellation of your data / contact

You have the right to request a copy of the information we hold about you. At any time you can request which personal data are processed by us, as well as the rectification or cancellation of your data, by sending a written communication, together with the attestation of your identity, to the following address: info@hubplasma.com

In case of incorrect information, we will update you upon your request.

It is possible to ask us to delete your data and not to use it anymore. If you have consented to the use of your data for marketing purposes, you can withdraw this consent.

In some cases we are required by law to retain data for which you have withdrawn consent.

The deletion of your data may prevent us from offering you some services related to our products.

13. Complaints and supervisory authorities

If you have the impression that we have processed your personal data improperly, you can contact us at any time. The Federal Data Protection and Information Commissioner ("FDPIC") is responsible for the enforcement and supervision of data protection in Switzerland. 14. Updating and changing the data protection declaration

At our discretion and without notice, we may update, change, supplement or otherwise revise this data protection declaration from time to time. We will endeavor to inform you of any significant changes, but we recommend that you check this statement regularly to ensure that you have read the most recent version.
